Delhi Court Grants Default Bail to Six Ukrainian Nationals in Myanmar Training Case

A Delhi court on Wednesday granted default bail to six Ukrainian nationals arrested over allegations of providing training to an ethnic armed group in Myanmar.

The six accused were granted bail upon furnishing a personal bond of Rs 1 lakh each. The court also discharged them from the charges registered against them under the Immigration and Foreigners Act, 2025.

Earlier, the Foreigners Regional Registration Office (FRRO) had disposed of the offences registered under Sections 21 and 23 of the Act. The six foreign nationals had each been fined Rs 5.5 lakh for allegedly violating visa conditions and entering Myanmar without the required Restricted Area Permit.

The six Ukrainian nationals — Petro Hurba, Taras Slyviak, Ivan Sukmanovskyi, Marian Stefankiv, Maksym Honcharuk and Viktor Kaminskyi — were arrested by the National Investigation Agency (NIA) in March from different airports and locations.

Meanwhile, US national Matthew VanDyke, who was also arrested in connection with the case, was granted bail last week. During the hearing of his bail application, Special Judge Prashant Sharma observed that other accused persons placed in the same legal position could also be entitled to default bail if they filed applications.

The NIA had initially registered a case against seven foreign nationals under the Unlawful Activities (Prevention) Act, 1967. However, the UAPA provisions were not included in the chargesheet filed earlier this month. The charges against the accused were limited to Sections 21 and 23 of the Immigration and Foreigners Act.

The investigation into the case, however, is still underway. According to NIA Special Public Prosecutor Rahul Tyagi, the investigation into the alleged terror-related activities is continuing, and a supplementary chargesheet may be filed at a later stage.
