Train Leaves Nearly 2 Hours Early Without Notice, Family Forced to Take Flight; Consumer Court Orders Railways to Pay Compensation

A passenger who arrived at the station with his wife and daughter according to the scheduled departure time found that the train had already left. The consumer commission has directed the Railways to pay Rs 15,620 in refunds and compensation.

A family’s journey turned into an unexpected ordeal after their train departed nearly two hours ahead of its scheduled time without prior notification. The passenger, who had arrived at the railway station with his wife and daughter according to the departure time printed on their tickets, was shocked to discover that the train had already left.

With no alternative available to reach their destination on time, the family was forced to book flight tickets, incurring additional expenses. Taking note of the alleged negligence, the District Consumer Disputes Redressal Commission has directed the railway authorities to refund the ticket fare and pay additional compensation totalling Rs 15,620.

The incident took place on June 10, 2024. The complainant had booked three train tickets for himself, his wife and daughter to travel from Madgaon in Goa to Hazrat Nizamuddin in Delhi. The family had paid Rs 10,620 for the tickets.

According to the complaint, the family reached the station before the scheduled departure time mentioned on their tickets. However, they were informed that the train had already departed nearly two hours earlier following a change in its timetable.

The passenger alleged that neither the Railways nor the Indian Railway Catering and Tourism Corporation (IRCTC) had directly informed him about the revised schedule.

When he approached the station master with his complaint, he was reportedly told that informing passengers about changes in train timings was the responsibility of IRCTC.

Left with no other option, the family purchased flight tickets to reach Delhi as scheduled. The incident not only caused additional financial expenses but also subjected them to considerable inconvenience and mental distress.

Defending its position, the Railways argued that trains operate under a different timetable during the monsoon season. According to the railway authorities, the monsoon timetable remains in effect every year from June 10 to October 30.

The Railways claimed that the revised schedule had been displayed on station notice boards, announced through public address systems and published on the Konkan Railway website. It further argued that passengers were also responsible for checking the latest train timings before travelling.

Meanwhile, IRCTC maintained that its role was limited to online ticket bookings and that it had no direct involvement in train operations or changes to railway schedules.

However, the Firozpur District Consumer Disputes Redressal Commission rejected these arguments. It observed that railway authorities cannot escape responsibility merely by displaying revised schedules on websites or station notice boards.

The commission emphasised that passengers must be properly informed about significant changes to train schedules and that the responsibility lies with the concerned authorities.

Holding Northern Railway, Konkan Railway and IRCTC responsible for deficiency in service, the commission directed them to compensate the affected passenger.

As per the commission’s order, the passenger must receive a refund of Rs 10,620, representing the amount paid for the train tickets.

In addition, the authorities have been directed to pay Rs 5,000 towards mental agony, harassment and litigation expenses.

The total amount payable to the passenger stands at Rs 15,620.

The ruling highlights the responsibility of railway authorities to ensure that passengers are adequately informed about changes in train schedules and are not left stranded due to a lack of timely communication.
